Defense Arrangement Treaty (of the) Alliance of Signatory States

The Defense Arrangement Treaty of the Alliance of Signatory States is a mutual defense treaty created in YE 36 at the International Relations Conference of YE 36. It was originally introduced by the Democratic Imperium of Nepleslia and minor modifications were made by the Yamatai Star Empire.

Nations included in the treaty are:

  1. Yamatai Star Empire
  2. Democratic Imperium of Nepleslia
  3. Lorath Matriarchy

Preamble

  • 1. “Defense Arrangement Treaty (of the) Alliance of Signatory States” shall be referred in the terms of this document as the Treaty (“Treaty”)
  • 2. The Democratic Imperium of Nepleslia and the Lorath Matriarchy at first signing are Signatories to this Treaty (“Signatories” singular “Signatory”).
  • 3. New Signatories can be added to this Treaty with the consent of all current Signatories and the prospective Signatory, upon which they will be regarded for all intents and purposes as Signatories.
  • 4. Any other sovereign parties who are not Signatories are known as Non-Signatories (“Non-Signatories” singular “Non-Signatory”)
  • 5. This Treaty aims to maintain peace in known space and to provide a comprehensive framework for cooperative military defense and security between Signatories.
  • 6. Once this Treaty is ratified by the Signatory’s own legislative bodies, all the terms of this Treaty become equally binding on all Signatories.
  • 7. The terms of this Treaty are to be made publicly available to all Signatories and Non-Signatories
  • 8. This Treaty is in force from the date of first signing indicated at the end of this document.

Military & Territorial Claims

  • 9. The Signatories will not violate the territorial integrity, political independence or security of any of the Signatories. This includes and is not limited to military actions, political funding, economic sabotage or covert espionage.
  • 10. The Signatories will consult together whenever in the opinion of any of them, the territorial integrity, political independence or security of any of the Signatories is threatened.
  • 11. Garrison arrangements should be arranged individually between signatory states, notwithstanding the following: Any supplies, land, services, permits or licenses that have to be purchased or imported in the Garrisoned State by the Garrison Force cannot be taxed. The responsibilities of the Garrison force are firstly to protect the sovereignty of the Garrisoned State and secondly to protect the public and private interests by the Signatory State they belong to in the Garrisoned State. These responsibilities by the Garrison Force do not waive the very same responsibilities of Garrisoned State the Garrison Force are stationed in. The Garrison forces are allowed free travel throughout the public areas of the Garrisoned State they are stationed in. Garrisoned Forces cannot be armed at any public government functions.
  • 12. Joint military exercises and consultations are to be held between Signatories to highlight any potential military deficiencies and to ensure that the efficiency of any joint military action is maximised.
  • 13. Signatories are obliged to disclose available military intelligence on Non-Signatories to other Signatories provided such disclosures would not compromise the future gathering of such intelligence.
  • 14. Signatories are to first seek an equitable nonviolent solution to any diplomatic conflict between Signatories and Non-Signatories. Military action is to be considered a last resort.
  • 15. Signatories may only declare war on other Non-Signatories with the consent and approval of all Signatories. Any Non-Signatory that has been declared war on in this manner is now a Belligerent State (“Belligerent State”).
  • 16. An act or declaration of war by a Non-Signatory on any one Signatory is an act or declaration of war on all Signatories. That Non-Signatory is now a Belligerent State.
  • 17. All Signatories are obliged to aid each other mutually in all practicable manners against any Belligerent State, including and not limited to military intervention, cooperation and aid.
  • 18. No Signatory is to pursue a separate peace with any Belligerent State.
  • 19. Full military accesses are to be granted by each Signatory State to all Signatory States in the event of war. Signatories are to inform other Signatories of the movement of their own forces in other Signatory States unless it is militarily detrimental to the war as a whole.
  • 20. Signatories are obliged to return any territory recaptured from Non-Signatories to any Signatory who has formerly owned it.

Territorial Claims

  • 21. (There is no point 21)
  • 22. Signatories are to respect each other's territorial claims
  • 23. Signatories are not to respect territorial claims by Non-Signatories where they would conflict with the territorial claims of a Signatory.
  • 24. Signatories staking any new territorial claims are to inform all fellow Signatories in advance. Any objection is first to be settled via negotiations between the staking Signatory and the objecting Signatory, failing which the matter is to be referred to the Council of Signatories.
  • 25. The decision to respect any territorial claims by Non-Signatories is to be made unanimously by all Signatories.

Security

  • 26. Signatories are obliged to disclose available intelligence on criminal elements to other Signatories provided such disclosures would not compromise the future gathering of such intelligence.
  • 27. The security forces of a Signatory are allowed to pursue criminal elements into another Signatory's space (“Intruded Signatory”) provided a request for permission from the Security Force is sent and received by the Intruded Signatory. If permission is denied while the security forces are in the Intruded Signatory's space, security forces are to immediately return to their own space if not in immediate danger. This will carry no diplomatic repercussions between the Signatories.
  • 28. Signatories are to capture and repatriate criminals wanted in other Signatory States to the Signatory State in which they are wanted in, after they have been given a fair trial and served their sentences for any crimes they have committed in the Signatory State which they have been captured in.

Rights

  • 29. Citizens belonging to each of the Signatories are to enjoy civil rights similar to the Citizens whose territory they are currently on without discrimination, subject to the following exceptions:-
  • 29(a). Non-citizens may be discriminated against Government employment and any employment crucial to national or public security;
  • 29(b). The freedom to contract between Citizens of Lorath Matriarchy with specific regard to duration of contract and personal liberty as consideration are to be respected by all Signatory States; and

  • 29(e). This section does not extend to political rights, including and not limited to voting in government or political party elections or the right to stand as a candidate for such elections.

Aid

  • 30. Signatories are obliged to render humanitarian aid to other Signatory States experiencing a humanitarian crisis (“Victim State”), consent from the Victim State must be received but can be presumed if the central and then local authority of the Victim State cannot be reasonably contacted.
  • 31. Signatories are obliged to accept refugees from Victim States and to provide them a standard of care equivalent to their own citizens.
  • 32. Signatories cannot repatriate refugees without the refugee's consent.

Council of Signatories

  • 33. Signatories are to contribute three representatives to a Council of Signatories (“Council”). Any dispute in implementation, application or interpretation of this Treaty is to be referred to the Council. The Council cannot vary any terms of this Treaty. The Council is regarded to have arrived at a decision when more than half of its members are in agreement. In matter of war, the agreement of two thirds of its members is required. Representatives may be changed by the Signatories they were contributed by at any time.
  • 34. Any violation of this Treaty by any Signatory is subject to punitive measures decided by the Council including and not limited to liquidated damages, injunctions, suspension and expulsion from the Treaty.

Embassies

  • 35. Signatories are to establish embassies in each other Signatory State. Land is to be set aside for these embassies free of charge, and all supplies, land, services, permits or licenses that have to be purchased or imported for the day to day running of the embassy cannot be taxed.

Other

  • 36. The duration of this Treaty is to be four years from the date of first signing or four years from the date of official cessation of hostilities between the Signatories and Non-Signatories, whichever is later.
  • 37. Signatories may only leave the Treaty at the end of its duration or with the consent of all Signatories, subject to a one year notification in advance.
  • 38. This Treaty may be renewed at the end of its duration by mutual consent of all Signatories, at which this Treaty is to be extended by another four years or four years from the date of official cessation of hostilities between the Signatories and Non-Signatories, whichever is later.
  • 39. In the event of renewal, Signatories retain the right to leave the Treaty on the day the Treaty would have expired.
  • 40. The terms of this Treaty may be renegotiated at any time subject to the unanimous consent and approval of all Signatories.
  • 41. Signatories are not to enact any legislation or enter in any treaties which may conflict with any terms of this Treaty or allow a Non-Signatory to benefit from this Treaty.
  • 42. Signatories may not request for payment or any other consideration from another Signatory for any aid or action required to be performed or given under this Treaty other than for the sale of military hardware during peacetime.
