Senate Proposal 4: Universal Code of Military Law

Overview

This act is meant to introduce a universal law punishing any wrong-doing of military personnel.

Section 1 – Those Affected by these Laws

Article A: Members of the Star Military of the Democratic Imperium of Nepleslia Marine Corps branch .

  • All enlisted members, from ranks E-0 to E-5.
  • All Warrant and Joint Officers, from ranks WO-1 to WO-3.
  • All Officers, from ranks OF-1 to OF-5

Article B: Members of the Star Military of the Democratic Imperium of Nepleslia Naval Corps.

  • All enlisted members, from ranks E-0 to E-4.
  • All Warrant and Joint Officers, from ranks WO-1 to JO-1.
  • All Officers, from ranks OF-1 to OF-5.

Article C: Members of the Star Military of the Democratic Imperium of Nepleslia Central Corps.

  • All enlisted members, from ranks E-0 to E-4.
  • All Warrant and Joint Officers, from ranks WO-1 to JO-1.
  • All Officers, from ranks OF-1 to OF-5.

Article D: Members of the Star Military of the Democratic Imperium of Nepleslia Public Relations Corps.

Section 2 - List of Offenses and Punishments

Article A: General List of Offenses.

  • Conspiracy
  • Desertion
  • Absent Without Leave
  • Disrespect toward superior commissioned officer
  • Assaulting or willfully disobeying superior commissioned officer
  • Failure to obey a lawful order or regulation
  • Mutiny
  • Resistance, flight, breach of arrest, and escape
  • Releasing prisoner without proper authority
  • Noncompliance with procedural rules
  • Aiding the enemy
  • Espionage resulting in aiding the enemy
  • Military property - Loss, damage, destruction, or wrongful disposition
  • Riot
  • Murder
  • Manslaughter
  • Rape
  • Stalking
  • Larceny
  • Arson
  • Extortion
  • Assault
  • Burglary
  • Conduct unbecoming of an officer and gentleman
  • Any conduct not listed above that may “cause disorder and neglect to the prejudice of good order and discipline in the armed forces, or conduct of a nature to bring discredit upon the armed forces.”

Article B: Offenses Punished by Court Martial and Demotion.

  • Conduct unbecoming of an officer and gentleman
  • Riot
  • Assault
  • Failure to obey a lawful order or regulation
  • Absent Without Leave
  • Desertion
  • Military property - Loss, damage, destruction, or wrongful disposition
  • Noncompliance with procedural rules
  • Releasing prisoner without proper authority
  • Assaulting or willfully disobeying superior commissioned officer
  • Any conduct not listed above that may “cause disorder and neglect to the prejudice of good order and discipline in the armed forces, or conduct of a nature to bring discredit upon the armed forces.”

Article C: Offenses Punishable by Imprisonment of 10 years or more and Dishonorable Discharge.

  • Larceny
  • Burglary
  • Arson
  • Assault
  • Extortion
  • Stalking
  • Manslaughter
  • Rape
  • Resistance, flight, breach of arrest, and escape
  • Murder in the 2nd, 3rd and 4th degree
  • Any conduct not listed above that may “cause disorder and neglect to the prejudice of good order and discipline in the armed forces, or conduct of a nature to bring discredit upon the armed forces.”

Article D: Offenses Punishable by Execution

  • Murder in the 1st Degree
  • Aiding the enemy
  • Espionage resulting in aiding the enemy
  • Mutiny
  • Conspiracy

Section 4 – Jurisdiction to try personnel and territorial applicability of this section.

  • All terrestrial bases belonging to the Star Military of the Democratic Imperium of Nepleslia.
  • All space bases belonging to the Star Military of the Democratic Imperium of Nepleslia.
  • All starships belonging to the Star Military of the Democratic Imperium of Nepleslia and her allies.
  • Members of the Star Military of the Democratic Imperium of Nepleslia are exempt from Police Law, and are tried according to Military Law.
  • Members of the Military of the Democratic Imperium of Nepleslia can be tried for crimes done during shore leave or while off-duty.
  • This law does not cover accusations brought onto members of all branches of the Star Military of the Democratic Imperium of Nepleslia before its inception.

Section 5 - Pre-Trial and Trial of Subjects

Article A: Pre-Trial Procedure

  • Subject is to be apprehended at any time. Use of lethal force authorized should the subject resort to violence.
  • Subject is to be detained until the trial itself begins. No bail.
  • Investigations into the crime will commence.

Article B: Trial Procedure

  • Subject is to be tried by a jury of his peers.
  • Jury is to be chosen randomly from all branches.
  • Evidence is to be brought against the subject.
  • Subject is given the opportunity to defend his or her position.
  • Trial closes with the verdict.
  • Armed ID-SOL escort the subject out of the courthouse to either be released, sent to prison, discharged, or executed by firing squad.

Section 6 – Exemptions from Punishments

Article A: Exempted by Performing Forced Labor

  • To be performed until released by a Officer ranking higher than OF-3 or by an overseer in high standing in the event of a court-martial.
  • To be performed in the amount of time originally sentenced to jail
  • To be performed for a life sentence if sentenced to execution.
  • To be performed in the maintaining of all military installations.
  • To be performed on any mining operations.
  • To be performed in military construction.

Article B: Exempted by Participating in Experimentation

  • To be performed in the amount of time originally sentenced to jail if experiments are deemed to be of low to medium risk.
  • To be performed for a life sentence if sentenced to death.
  • To be performed in experiments benefiting advancement in military technology, including: health technology, chemical and biological warfare, in social and psychological experimentation.
